These Terms and Conditions ("Terms") govern your access to and use of Burg Commercial Rental Services SP's services, including renting and listing vehicles, and using related services provided by Burple ("we," "us," or "our"). By accessing, registering, or using Burg Commercial Rental Services SP, you agree to comply with these Terms.

2. Definitions

• "User" refers to any individual or entity accessing Burg Commercial Rental Services SP, including renters, vehicle owners, and agencies.
• "Renter" refers to any user renting a vehicle through Burg Commercial Rental Services SP.
• "Owner" refers to the individual, agency, or entity listing a vehicle for rent.
• "Platform" refers to Burg Commercial Rental Services SP and all associated services.
• "Agreement" refers to this Terms and Conditions document.

3. Eligibility

• You must be at least 18 years old to use Burg Commercial Rental Services SP.
• Renters must hold a valid driving license and comply with all legal requirements for vehicle operation in the applicable jurisdiction.
• Owners must have legal ownership or authorization to list vehicles for rent.

4. Account Registration

5. Vehicle Listings

• Owners must provide accurate details about their vehicles, including images, registration details, and rental terms.
• Vehicles listed must be roadworthy, insured, and legally compliant.
• Owners must keep their listings updated and notify Burg Commercial Rental Services SP of any unavailability.

6. Booking and Rental Process

• Renters must provide required personal and payment information before booking.
• Owners have the right to accept or decline rental requests.
• Payments will be processed via Burg Commercial Rental Services SP's integrated payment system.
• Agencies and users are not permitted to contact each other directly; all communication must go through Burg Commercial Rental Services SP's platform.

7. Payments, Fees, and Cancellations

• Burg Commercial Rental Services SP charges a service fee for each transaction, deducted from rental payments.
• Renters must pay rental charges in full before vehicle handover.
• Cancellations may be subject to fees based on the timing of the cancellation.

8. Responsibilities of Renters

• Renters must return the vehicle in the same condition as received, barring normal wear and tear.
• Any damage or fines incurred during the rental period are the renter's responsibility.
• Vehicles must not be used for illegal activities, sub-renting, or commercial purposes without prior approval.

9. Responsibilities of Owners

• Owners must provide a safe, roadworthy, and legally compliant vehicle.
• Vehicle insurance is the sole responsibility of the owner.
• Any disputes regarding the condition of the vehicle must be resolved between the renter and the owner through Burg Commercial Rental Services SP.
• Burg Commercial Rental Services SP is not liable for any damages or losses arising from a rental agreement.

10. Insurance and Liability

• Owners must ensure their vehicles have valid insurance coverage.
• Renters are responsible for any insurance claims resulting from their use of the vehicle.
• Burg Commercial Rental Services SP offers optional third-party rental insurance for an additional fee.
• Burg Commercial Rental Services SP is not liable for accidents, damages, theft, or disputes arising from rentals.

11. Dispute Resolution

• Burg Commercial Rental Services SP will assist in dispute resolution between users but does not guarantee outcomes.
• Disputes between users must first be attempted to be resolved directly through Burg Commercial Rental Services SP's mediation services.
• Legal disputes will be governed by the jurisdiction of India.
